DALLAS (CN) - Former NFL receiver Sam Hurd bought 200 lbs. of marijuana while awaiting trial on charges of trying to set up a drug ring, federal prosecutors said.
Hurd, 26, of San Antonio, was arrested on a motion for arrest and revocation of pre-trial release.
He had been released on Dec. 16, 2011 on $100,000 bond, two days after he allegedly met at a Chicago steakhouse with an undercover federal agent and agreed to buy several kilograms of cocaine and 1,000 pounds of marijuana a week, for resale. Hurd, a former Dallas Cowboy and then a Chicago Bear, was released by the Bears days later.
Hurd and Toby Lujan, 26, of Dallas, were charged in Dallas Federal Court with conspiracy to possess with intent to distribute 5 kilograms or more of cocaine, and possession with intent to distribute 500 grams or more of cocaine.
In June, While Hurd was free on bond and awaiting trial, Jesse Tyrone Chavful, Hurd's cousin and co-defendant, was arrested after trying to buy 5 kilograms of cocaine and 200 lbs. of marijuana on Hurd's behalf, according to prosecutors' motion.
Prosecutors say Chavful acknowledged that months earlier, Hurd went to his T-shirt shop in San Antonio and asked him to get him "something," meaning cocaine and marijuana.
"Chavful stated that in May 2012, he delivered 30 pounds of marijuana packed in a blue ice chest to Hurd at his T-shirt shop," the motion states. "Hurd payed [sic] $10,500 in cash for the marijuana.
"Chavful also stated that the cocaine and marijuana that he had tried to acquire from an undercover agent at his T-shirt shop on June 6, 2012, was suppose [sic] to go to Hurd."
Prosecutors say Chavful's admission of having cellular phone contact with Hurd during key points of the delivery is corroborated by telephone records indicating he had called a phone belonging to Hurd's sister three times after Chavful had been told the drugs were en route to his shop.
Hurd flunked two drugs tests for marijuana in May and July and admitted he had used marijuana, according to the motion.
