WASHINGTON (CN) - Shares in Rambus Inc. spiked Tuesday after the Federal Circuit dismissed Samsung Electronics Co.'s claim for attorney fees in a patent infringement dispute over dynamic random access memory devices, or DRAM.
Rambus and Samsung swapped suits over four Rambus patents that Samsung allegedly infringed, but the case was dismissed as moot after Rambus filed covenants not to sue Samsung and to voluntarily dismiss its infringement counterclaims. But Samsung's claim for attorney fees remained in the Virginia district court.
The appellate ruling vacates the district court's order denying Samsung's motion for attorney fees and issuing a "lengthy opinion addressing issues relating to the alleged spoliation of evidence by Rambus, but not relevant to the basis for judgment in favor of Samsung," the circuit wrote.
Rambus offered to pay Samsung's requested attorney fees in full, rendering Samsung's complaint moot, the court said. The three-judge panel vacated the order and remanded with instructions to dismiss.
