TRADE, CLASS ACTIONS - The Federal Circuit rejected a challenge to a deferred duty imposed on chemical products imported from Australia and the Netherlands. Chemical companies claimed the duty violated the U.S. Constitution and sought class certification, but the court found the duty constitutional, rendering certification moot.
