Federal Chamber of Commerce Took it|For a 6-Year Ride, Restaurant Claims

LAS VEGAS (CN) - A Mexican restaurant claims the Federal Chamber of Commerce bilked it of $42,872 over 6 years by withdrawing $600 a month from its account even though its employees had "flatly refused" the Chamber's offer of health insurance and never received the billed services.

Bonita Michoacan claims the chamber "improperly sold" a group membership to the restaurant "under the guise that the plan would assist member employees and employer with medical costs of each employee," the restaurant claims in Clark County Court.

During a meeting in 2003, defendant Sophia Guerrero sought and received information about each employee at the restaurant, and "misrepresented her product as medical insurance," according to the complaint.

The restaurant says the chamber's offer for services was "flatly refused by all in attendance."

Nonetheless, the chamber began automatically deducting $600 a month from the restaurant's business account, and did it each month since 2003, according to the complaint.

The chamber "knowingly and purposefully defrauded plaintiffs out of this money, and provided absolutely no service in return," the lawsuit states.

Bonita Michoacan seeks damages for breach of contract and fraud.

Along with the chamber, individual defendants include Buck Reed, Sheri Sharman, Larry Kozin, Arnie Katz, Philip Maruncic and Guerrero.
