FBI Officers To Proceed With Labor Class Action

WASHINGTON (CN) – The Court of Federal Claims allowed FBI officers to pursue a class action against the government for failure to increase their salaries. Judge Hewitt found that the court has jurisdiction because the case is based on a money-mandating U.S. code covered by the Tucker Act.

Jeffrey King, Scott Austin, Kevin Harris and John Hays seek relief under the Back Pay Act of 1996.
Hewitt agreed with the plaintiffs’ assertion that when FBI police officers were established, they were entitled to “receive pay equivalent to the Uniformed Division of the Secret Service.”
