Family Says Negligence Led to Lightning Injury

(CN) - The family of a Florida man struck and seriously injured by lightning says his employer's negligent refusal to clear the worksite as violent storm approached caused their loved one's misfortune.

In a lawsuit filed in the Miami-Dade County Circuit Court, Sergio Museguez's wife and mother say he was working as a heavy equipment operator in Homestead, Fla., when "an intense, forecasted lightning storm grew over the job site."

Despite this, they say, neither defendant MG3 Developer Group, which was undertaking the project, or Geosite Inc, Musequez's employer, took any steps to ensure their employees' safety or even urged them to take cover.

Musequez, 48, was struck by lightning and so seriously injured that he now needs ongoing nursing care and treatment.

Plaintiffs Leidi Hernandez and Liset Museguez say neither of the defendants had adequate workers' compensation insurance at the time of the incident.

They seek damages on multiple claims of negligence, and are represented by Stephen Cain of Stewart, Tilghman, Fox & Bianchi of Miami.
