MIDDLESEX, Mass. — A Facebook commenter prevailed in a Massachusetts court of appeals on attorney Scott Lucey’s defamation claims over their irate online comment: “I’m beginning to wonder if you are capable of reading. Might want to read again and anybody who would hire you to be their attorney God Bless them, because someone must have taken the Bar exam for you.” An ordinary person would not read the comment as a statement of fact and the comment also doesn’t qualify as petitioning activity to the city council even if it was made in a city politics group.
