FAA Workers Entitled to Overtime, Court Rules

WASHINGTON (CN) - The U.S. government wrongfully failed to pay overtime to 7,000 employees of the Federal Aviation Administration, the Court of Federal Claims ruled.

Instead of giving "time and one-half" overtime pay, the government awarded "credit hours" to its employees for working overtime.

These credit hours were awarded on a 1-to-1 basis, instead of a 1-to-1.5 basis. Also, the credit hours could be forfeited under certain circumstances.

Judge Hewitt agreed that the government's overtime system violated the Fair Labor Standards Act.

The parties will go to trial, however, on the workers' claims that they should be paid for the time they spend on pre- and post-shift duties and on bidding for vacation leave.
