Excessive Force Defense

An appeals court in New Mexico ruled that a woman who pointed a taser at a police officer and grabbed his wrist while her son was being arrested was improperly convicted of battery upon a police officer. The woman was entitled to a “defense of another instruction” against the use of excessive force directed at her son.
