Excessive Force

A Ninth Circuit panel denied petitions for rehearings in an excessive force case stemming from the death of Joseph Slater, who died in the back of a police car after being restrained.

SAN BERNARDINO, Calif. – The Ninth Circuit panel denied petitions for rehearings in an excessive force case stemming from the death of Joseph Slater, who died in the back of a police car after being restrained.

The original panel ruled the officers “violated clearly established law." Dissenting judges said Tuesday, however, the ruling continues the court’s “troubling pattern of ignoring the Supreme Court’s controlling precedent concerning qualified immunity in Fourth Amendment cases.”
