Excessive Force

A federal court in California denied the City of Tehachapi’s motion for summary judgment in an excessive force case brought by a man who was shot twice in the back during a foot pursuit by police officers. There is a triable issue of fact as to whether the officers had a “reasonable belief” the man was armed at the time of the shooting.
