BOSTON (CN) - A Brazilian mayoral candidate who allegedly received death threats against himself and his family during and after his campaign failed to convince the 1st Circuit that he should be allowed to stay in the United States under the Convention Against Torture.
The alleged threats against Genario Vincente de Oliveira never escalated to violence and stopped when Vincente left the town of Cuparaque, where he ran for mayor.
The fact that his son, who was active in his campaign, has been living peacefully in Brazil since 2005, further undermined his persecution claim. Similarly, his wife and two other children stayed behind when he fled to the United States, but none has been harmed.
These circumstances led the court to conclude that Vincente did not have a reasonable fear of future persecution, particularly given that some of the alleged threats had directly targeted his children.
