Escort Claims Defamation

LOS ANGELES (CN) - A Long Beach woman who works as an escort claims a man defamed her because she refused to have sex with him.

The woman says she worked under a fictitious name out of Long Beach as a model, entertainer and escort. She had a Web site under her pseudonym that she used to promote her services.

She claims David Elms, owner of Elms Web Services, stole copyrighted pictures and videos from her site and posted them on a Web with the URL of her real name.

Elms did so, she says, to retaliate "because she refused to engage in sexual intercourse with him" and would not allow him to post her real name on an erotic Web site he owns and operates.

She says Elms also posted her home address on the Web site, defamed her by calling her "a coke addict," and claims she misrepresented herself as holding a Ph. D. And she says he sent letters to her family telling them that she worked as an escort.

She says she had to move because men were seeking her at home, and that members of her family have stopped communicating with her.

She also claims she has suffered loss of business.

She demands punitive damages for defamation, privacy invasion, copyright infringement and emotional distress. She is represented by Michael Fattorosi of Woodland Hills.
