Enviros Sue EPA to Protect Historic District

CHARLOTTESVILLE, Va. (CN) - A nonprofit land preservation group wants the U.S. EPA to revoke the permit it granted that lets a wastewater treatment plant pump treated sewage into a creek that runs through a Historic Landmark District and into Chesapeake Bay.

The Historic Green Springs group says the EPA issued the permit for the Zion Crossroads Wastewater Treatment Plant in Louisa County to discharge pollutants into Camp Creek without studying its effects on the quality. The group says the permit violates the Clean Water Act.

Historic Green Springs was formed in 1970 to preserve more than 250 landmarks from the 18th and 19th centuries in the Landmark District. Private property owners in the District have placed 13,000 acres of its 14,000 acres into conservation. Camp Creek flows through two of those easements.

Historic Green Springs says the EPA did noting to respond to its concerns about the pollution caused by the discharge permit. It sued the EPA and the Louisa County Water Authority for failing to perform nondiscretionary duty under the Clean Water Act and the National Historic Preservation Act.

It seeks declaratory relief and an injunction. The group is represented by David Bailey with the Environmental Law Group of Richmond.
