Environmental justice in Peru

ST. LOUIS — The Eighth Circuit declined to dismiss 40 consolidated lawsuits brought by over 1,420 Peruvian citizens who say they were exposed to toxic materials at a rural Peruvian smelting complex and refinery run by U.S.-based companies. The doctrine of international comity does not require the court to dismiss the matter out of deference to Peru’s legal remedies, as apparently there is no “adequate forum or remedy available to the plaintiffs under Peruvian law.”
