‘English Only’ Initiative Challenged In Nashville

NASHVILLE (CN) - Davidson County is wasting public money on a special election on an unconstitutional initiative that states, "No person shall have a right to government services in any other language" than English, says a legal resident born in El Salvador who has limited proficiency in English. Early voting already has started on the "English Only" amendment.

Rosa Quinteros says the amendment is unconstitutional on its face and will hurt her as she lives and works here legally "and has the need to speak with and communicate with departments and employees of [defendant] Metropolitan Nashville Davidson County".

She wants the election enjoined and the law enjoined as unconstitutional if voters approve it. The proposal would amend the Nashville-Davidson County Metro Charter. The special election will cost the metro government $300,000 to $350,000, the complaint states.

Election Day is Jan. 22, 2009. Quinteros is represented in Davidson County Chancery Court by David Randolph Smith.
