Energy Company Loses Bid For Dredging Permission

     WASHINGTON (CN) – The D.C. Circuit rejected an energy company’s attempt to force state environmental agencies to certify that its proposed dredge-and-fill operations in Massachusetts’ Taunton Bay and the Mount Hope Bay in Rhode Island complied with the Clean Water Act.




     The appeals court dismissed the claims of Weaver’s Cove Energy, which accused environmental agencies in Rhode Island and Massachusetts of waiving their right to deny the requested certification by ignoring the petition for more than a year.
     But the company lacks standing, the court ruled, because it was unable to show any tangible injury caused by agency inaction.
