Emissions FOIA suit reinstated

NEW ORLEANS — The Fifth Circuit reversed a Texas federal court’s judgment in favor of the Department of State. A conservative think-tank, the Texas Public Policy Foundation, sued after it received no response to its Freedom of Information Act request for Paris Agreement emissions reduction target records. The Fifth Circuit finds that FOIA Exemption 6, which shields information that could subject individual employees to harassment, does not apply because the info would help the public learn of the employees’ seniority, backgrounds and areas of expertise.
