MARSHALL, TEXAS (CN) - The East Texas Electric Cooperative sued the Sierra Club and the U.S. Department of Agriculture's Rural Utilities Service, demanding $240 million in loans for two coal-fired electric plants. The co-op says it doesn't own a big enough share of the plants to control them, or their emissions, and Uncle Sam won't loan it the money because of Sierra Club litigation.
The co-op says the Rural Utilities Service has to loan it the money for the two plants, Plum Point and Turk, both in Arkansas. It claims the federal government violated the Administrative Procedure Act by denying it.
The co-op, which says it has 350,000 customers in East Texas, is represented in Federal Court by William Burchette of Washington, D.C.
