Election Fun in Florida

WEST PALM BEACH (CN) - A Republican congressman demanded that all ballots and voting machines in his district be impounded for a recount; the Palm Beach County Election Board immediately filed an objection.

Allen West, a Tea Party favorite, appears to have lost his race for re-election.

South Florida media had West 2,456 votes behind his Democratic challenger, Patrick Murphy, out of more than 300,000 votes cast.

That margin is not quite close enough to trigger a mandatory recount.

The Election Board opposed West's demand for an injunction, saying he "has not stated any cognizable claim for which relief may be granted under Florida's Election Code."

"There is no legal basis for a claim to halt the initial counting of votes, to leave hundreds or thousands of votes uncounted, and to impound ballots [and] voting machines in anticipation of a 'potential for a recount' which may never come," the Election Board said.

Provisional and absentee ballots are still being counted.
