‘El’ Riders Not Entitled to Refund for Expired Cards

(CN) – Riders of Chicago’s elevated train, the “El,” are not entitled to a refund of money left on their expired transit cards, an Illinois appeals court ruled.

Hugh Howard filed a class action against the Chicago Transit Authority, claiming it allowed transit cards to expire after a year and kept the unused money on the cards.
The trial court dismissed Howard’s complaint, and the Chicago-based First District Court of Appeals agreed that he is not entitled to a refund.
“The back side of the transit card said the card ‘must be used by the expiration date shown’ and ‘the purchaser does not have the right to have his/her card replaced, refunded, or redeemed for cash,” Justice Bertina Lampkin wrote.
