Double Jeopardy

Double jeopardy would not be violated by a retrial of defendants accused of murdering one of their husbands and hiding the body, an appeals court in New Jersey ruled. The trial judge initially declared a mistrial because the trial was interrupted by the Covid-19 pandemic.

JERSEY CITY, N.J. — Double jeopardy would not be violated by a retrial of Adrienne Smith and Orville Cousins on charges that hid the body after Smith killed her husband, a New Jersey appeals court ruled. The trial judge had declared a mistrial in mid-March as the spread of Covid-19 was better understood.
