Don Henley Challenges Campaign Use of Songs

LOS ANGELES (CN) - Eagles crooner Don Henley says Republican Charles DeVore used his songs, "The Boys of Summer" and "All She Wants to Do is Dance," to promote DeVore's campaign for U.S. Senator.

Fellow plaintiff Mike Campbell, guitarist for Tom Petty and the Heartbreakers, co-wrote "The Boys of Summer" with Henley.

Henley and Campbell also sued Justin Hart, DeVore's director of Internet strategies. DeVore serves as a member of the California State Assembly.

DeVore allegedly used "The Boys of Summer" "note for note" and rewrote the lyrics to suit his campaign. He and Hart posted a video using the song on YouTube. YouTube allegedly refused to remove the video without legal action on the part of Henley and Campbell.

Days after Henley and Campbell complained to DeVore about his use of "The Boys of Summer," DeVore allegedly made a second video using another song written by Henley, "All She Wants to Do is Dance."

Henley says he "carefully selects the particular causes he wishes to endorse" and does not support DeVore's campaign.

Henley and Campbell want damages and an injunction. They are represented in Federal Court by Paul Goldstein of Morrison & Foerster.
