LAS VEGAS (CN) - A recovering alcoholic says he got drunk from drinking a mislabeled energy drink that contained alcohol. He claims he was hospitalized after drinking a can of Shou Wu Chih, an energy drink sold by T&T Ginseng.
Leon Ostapiej says that on Jan. 13, 2008, he was hospitalized serious but unspecified injuries after drinking, apparently, a single can of the beverage.
In his complaint in Clark County Court, Ostapiej says the label did not state that the drink contained alcohol.
He seeks damages for negligence and failure to warn. He is represented by Christopher Raleigh.
