Disturbing Claim Against Children’s Hospital

CINCINNATI (CN) - The guardian of a 4-year-old who was sexually abused by her father claims that a hospital released her without any investigation "despite the fact that her father was a registered sex offender, he brought her to the hospital and she presented with ... obvious evidence of sexual abuse."

The guardian's and the girl's identity are kept anonymous in the complaint against the Children's Hospital Medical Center and two doctors there.

The court-appointed guardian for Jane Doe claims in the complaint: "The ward's father was a registered sexual offender that tortured, sexually abused and repeatedly raped the ward.

"On January 3, 2008, the ward, a 4 year and 5 month old little girl, presented to Children's Hospital Medical Center (CHMC) with active vaginal bleeding and a laceration to the right side of the vaginal wall, a torn hymen and other obvious evidence of sexual abuse.

"The ward's father was present with the ward on her presentation to CHMC and he claimed the ward had been injured by falling on a toy.

"The ward underwent examination and surgical repair of the hymen and vaginal wall while under general anesthesia.

"Despite the fact that her father was a registered sex offender, he brought her to the hospital and she presented with vaginal injury, a torn hymen and obvious evidence of sexual abuse, no inquiry or investigation was conducted to determine whether the ward was a victim of abuse.

"Shortly following the surgical repair, the ward was sent home with her father where she was subjected to continued and horrific torture, sexual abuse and rape."

The guardian claims the father abused the little girl for another 3 months before she taken to the hospital again, "at which time CHMC staff finally discovered the ward was a victim of abuse."

The guardian seeks medical expenses and punitive damages for negligence and violations of Ohio Revised Code 2151.421.

Named as defendants are Children's Hospital Medical Center and Drs. Michael S. Chua and Leslie L. Breech.

The guardian and little girl are represented by Zachary Gottesman.
