SANTA FE, N.M. (CN) - The New Mexico Secretary of State illegally allowed Eliot Gould to run for First Judicial District Attorney though he is not licensed to practice law in New Mexico, a retired attorney claims in state court. Candidates for the post must be "learned in the law," which "has been defined by the New Mexico Supreme Court as synonymous with 'licensed attorney,'" plaintiff Joseph Sena says. Sena says Gould could not exercise his duties of office, and is committing a criminal violation by running, as he is "hold(ing) himself out to the public as a person qualified to practice law."
Sena wants Gould's name stricken from the ballot.
In his own pro se complaint in the same court, Gould sued one of his opponents, Joseph Campbell, and Secretary of State Mary Herrera, claiming Campbell submitted a nominating petition with enough invalid signatures to disqualify him.
