(CN) - An officer had probable cause to arrest a wheelchair-bound man for drunk driving, even though the officer chose to forego the sobriety tests that involved walking or standing, the Missouri Court of Appeals ruled.
Overturning a ruling for David Pruessner, the judges concluded that the arresting officer had probable cause to arrest him without mobility tests, because Pruessner smelled of alcohol and failed alphabet and breath tests, and his eyes were watery and glassy.
