Disabled Group Home Worker Blamed for Pregnancy

MIAMI (CN) - The guardian of a mentally disabled woman claims in court that an employee of the incompetent woman's group home impregnated her.

K.W., by and through her legal guardian, The Guardianship Program Associates Villas, sued Consumer Supports Associates Villas Inc., in Miami-Dade County Court.

The plaintiffs claim a South Florida hospital confirmed that K.W. was 18 weeks pregnant in August 2010.

"After appropriate investigation, including DNA testing, it was determined that an employee of the defendant, Villas, one Parel Baker, was the male employee of the defendant who had gotten the plaintiff, (K.W.), pregnant.

"Said pregnancy was subsequently legally terminated upon the advice of appropriate healthcare providers," the complaint states.

It adds: "The defendant, Villas, through its employees, breached said duty owed by

negligently and carelessly hiring, retaining, and failing to supervise its employee, one Paret Baker, resulting in said employee having sexual intercourse with the incompetent female resident of the group home, the plaintiff, (K.) who was incapable of giving consent resulting in her pregnancy, the termination thereof, and losses and damages as hereinafter more fully alleged."

The plaintiffs seek damages for negligence, negligent supervision, breach of duty and respondeat superior. They are represented by Manuel Morales.
