Developers Lose Challenge To ‘U.S. Waters’ Definition

WASHINGTON (CN) - The D.C. Circuit affirmed dismissal of a developers' challenge to the U.S. Army Corps of Engineers' 1986 decision to include the Mojave River in its definition of "waters of the United States" that are regulated by the Clean Water Act. The court unanimously rejected the challenge for lack of subject-matter jurisdiction.
