LOS ANGELES (CN) - Dennis Quaid and his wife have accepted a $750,000 settlement by Cedars-Sinai Medical Center after the couple's newborn twins nearly bled to death after reportedly being given two massive doses of an adult blood thinner instead of the pediatric version.
Cedars-Sinai filed a petition asking the Superior Court to accept the settlement amount, saying Quaid had agreed to the settlement on behalf of himself and his wife Kimberly Quaid, but that the agreement would not settle any future claims on behalf of the twins.
According to the petition, Quaid filed a lawsuit against Baxter Healthcare Corporation, the company that makes Heparin, the drug Zoe Grace Quaid and Thomas Boone Quaid were given. The lawsuit alleges that the company failed to make the drug's packaging different enough from the packaging of the children's version. Both drugs are packaged in an identically-sized blue vial, Quaid said in an interview with CBS.
Quaid filed that lawsuit in Illinois, where it was dismissed because the 2007 overdose happened in California.
According to the petition, Quaid may re-file the action in Los Angeles. If that happens, Cedars-Sinai says it may find itself a co-defendant with Baxter, or a defendant in an indemnity action filed by Baxter.
