NEW LONDON, Conn. (CN) - A Connecticut woman says her plastic surgeon posted Before and After pictures of her breast augmentation surgery on his office's Web site though she explicitly refused to consent to it.
The woman says Nena Carlson Dr. Joel B. Singer, with Imperial Plastic Surgery of Westport, gave a consent form for "authorization for and release of medical photographs."
The first half of the form authorized Imperial to take "nude examination photographs" before, during and after surgery for clinical purposes. The plaintiff agreed to that, so she signed and dated that part.
The second half of the form contained a similar release that would allow Imperial to use her nude examination photographs in other ways, including posting them on the Internet "for purposes of medical education." She did not want photos of her used like that, and "did not sign or date this section of the consent form," according to the Superior Court complaint.
Years later, while telling a friend how "a breast augmentation can change one's appearance," the plaintiff says she went to Imperial's Web site to find pictures to prove her point. When she clicked on the link for "Breast Enlargement Before & After Photos," first examples that came up were her own nude breasts, she says.
She says Imperial complied with her demand to take the pictures off the Web site, but she does not know and has no control over whether the photos have been copied, or where they may appear in the future.
She seeks punitive damages for privacy invasions and negligence. She is represented by Michael Satti of Stonington.
