Dead Baby Tossed in|Gas Station Dumpster

(CN) - A Miami Beach funeral home employee wantonly tossed the corpse of a new born baby into a gas station Dumpster, the child's grieving family claims in court.

In a lawsuit filed in Miami-Dade County, the child's father, Raul Adrian Castro Manzano, says his son was born at Mount Sinai Hospital in Miami Beach, but died shortly after his delivery.

Manzano says he and his wife contacted defendant Carey Royal Ramn Mortuary and asked it to take possession of the baby's body for later cremation.

"A representative of the defendant, Carey, went to the Hospital to take possession of the deceased infant and either intentionally, willfully and wantonly disposed of the infants remains in or near a dumpster," the complaint says.

According to the Miami Herald, the baby's body was found by a man going through the dumpster looking for food. At the time, the Herald, said, the body was wrapped in a cloth and the bundle was inside a box. Still affixed to the baby was a toe tag bearing his identification.

The Herald said Jarren Hoob, son of the funeral home owner, was the worker who picked up the infant's remains at the hospital, but according to the newspaper, instead of taking the baby to a crematorium; he went home and left the body inside the company's van. He later watched the news on TV and went to the scene.

After seeing reports of the body's discovery on television, Hoob allegedly told police the "van had been burglarized and that the box holding the baby was among several boxes stolen.

North Miami police could not confirm that account.

Manzana seeks compensatory damages on claims of tortious interference with dead bodies, intentional infliction of emotional distress and breach of contract.
