DEA Sets Age Cap for Agents, Lawsuit Claims

DETROIT (CN) - The Drug Enforcement Administration maintains an illegal age ceiling that blocks investigators over the age of 37 from becoming special agents and receiving higher pay, seven aspiring agents claim in Federal Court.

The plaintiffs say they would qualify for the position, were it not for the agency's discriminatory age policy. They reject the rationale that the age limit ensures a physically fit special agent force, claiming that special agents "do not have to satisfy special physical requirements" after they leave the academy.

The agency's policy not only violates the Age Discrimination Enforcement Act, the plaintiffs claim, but it also robs investigators of potential earnings, community esteem and the advantages of being a special agent criminal investigator.
