(CN) - Fireman's Insurance ducked its obligation to cover Fox Entertainment's costs from a delay in filming the horror flick "Hide and Seek" after Robert De Niro's 2003 prostate cancer diagnosis, Fox claims in Los Angeles Superior Court.
Fox claims that Fireman's Fund Insurance rendered its $80 million policy "illusory" by suing De Niro after it paid the $1.8 million claim, though it knew Fox had to cover any claims the insurer filed against the actor.
After Fireman's sued De Niro, De Niro sued Fox and won, according to the complaint. Fox says it demanded that Fireman's defend it, but Fireman's refused.
Fox says De Niro's diagnosis came just before filming on the horror movie was scheduled to begin.
Fox demands more than $1.3 million for fraud and breach of contract. It is represented by Kirk Pasich with Dickstein Shapiro.
