Dating Service Cheated 81-Year-Old Widower, Niece Says

FREEHOLD, N.J. (CN) - An 81-year-old widower says a dating service billed his credit card $5,495 - not the $550 it promised - and refused his request for a refund, claiming that the old timer "had already met with a referral and professed his love for her."

James Allerton sued WLND Inc. dba Two Of Us Colts Neck and Jill Grossman, his "membership counselor," in Monmouth County Court.

Allerton claims the defendants massively overcharged his Visa card, and when he and his niece, who has power of attorney for him, called to complain, the defendants gave them the brushoff.

The niece says she told the defendants "that professing love for someone he met the same day goes to show that her uncle was not in the right frame of mind to understand and execute the contract since he was despondent over the recent death of his wife. She [the niece] said that the defendants had taken advantage of an elderly man who did not understand what he was signing. The representative said the contract was binding and no monies would be refunded."

Allerton seeks rescission, restitution, damages, attorney's fees and costs. He is represented by Simon Kaufman with Lomurro, Davison & Eastman of Freehold, N.J.
