D.C. Circuit

TRANSPORTATION, TORT - Kenneth Rosen was killed when an Airlink flight crashed on approach to a runway in Accra, Ghana, and his estate representative sued for damages. The D.C. Circuit ruled that the Warsaw Convention does not apply because Airlink did not operate international flights and could not have known about Rosen's travel intentions based on a single statement made to one employee.
