<span style="font-weight: 400;">The Fifth Circuit <a href="http://www.courthousenews.com/wp-content/uploads/2019/08/eeoctexas.pdf"><strong>ruled</strong></a> that the Equal Employment Opportunity Commission overstepped its authority when it issued guidance that would restrict Texas’ criminal record screening policies in its hiring process. </span>

HOUSTON – The Fifth Circuit ruled that the Equal Employment Opportunity Commission overstepped its authority when it issued guidance that would restrict Texas’ criminal-record screening policies in its hiring process.

A lower court’s injunction is modified to clarify that the EEOC and the attorney general cannot treat the guidance as binding in any respect, because the commission is not permitted to promulgate substance rules.
