BROOKLYN (CN) - The Daily News defamed a man by falsely calling him a convicted rapist in a story headlined, "Sickening: Jury sees tape of skull-smash gang's beating," the man claims in court.
Kyam Washington sued the Daily News in Kings County Supreme Court.
He claims the tabloid defamed him in a Jan. 22, 2013 story that identified him as "37-year-old Kyam Washington," describing him as: "The victim, an ex-con with a rap sheet that includes a rape conviction, [who] did not testify at trial."
Washington claims the News published and its reporter, Shayna Jacobs, wrote the story either knowing it was false and/or "with malice and with reckless disregard of whether it was true or false."
Jacobs is not named as a defendant.
Washington says the Daily News published a correction on Feb. 2, 2013.
He seeks $2 million in damages and $6 million in punitive damages.
He is represented by Michael Carlin.
