Court Tosses Ruling to Set Aside Death Sentence

(CN) - The U.S. Supreme Court tossed a ruling that set aside the death sentence of former Black Panther member Mumia Abu-Jamal, who was convicted of killing a Philadelphia cop in 1981 during a late-night traffic stop.

The high court wants the 3rd Circuit to re-examine its 2008 ruling that Abu-Jamal was entitled to a new sentencing hearing based on flawed jury instructions.

Abu-Jamal was convicted of killing Daniel Faulkner after the officer pulled over Abu-Jamal's brother.

Abu-Jamal, a former radio reporter born Wesley Cook, has been on death row since 1982.
