Court Tosses Harassment Claim Against Herbalife Founder’s Trustee

LOS ANGELES (CN) - The ex-wife of Herbalife founder Mark Hughes failed to show she was sexually harassed by a trustee of Hughes' $400 million estate, a state appeals court ruled.

Suzan Hughes claimed trustee Christopher Pair told her, "I'm going to get you on your knees and fuck you one way or the other." Suzan and Pair's contentious relationship stemmed from when Mark Hughes cut Suzan out of his will, specifying that the trust he established for their son, Alex, be "interpreted for all purposes as if Suzan predeceased" Mark. Suzan, who had to deal with trustees on Alex's behalf, filed seven lawsuits against the trust and trustees after Hughes' death in 2000. In 2005 she sought reimbursement for the two-month rental of a Malibu beach house that cost $80,000 a month; trustees gave her half. Pair later called Suzan and allegedly suggested he could give her more if she would "be nice," saying, "You know how much I love Alex and you in that special way." The court said Pair's comments did not constitute sexual harassment, and his acts did nothing to change their rocky relationship. See ruling.
