SAN FRANCISCO (CN) - A former managing director at the University of Colorado will get another shot to argue that he had been overly generous, not fiscally irresponsible, in granting employees too much paid leave.
The 9th Circuit remanded Mark Evers' allegation that the university was wrong to fire him as managing director of the Extended Studies Office on the basis that he granted paid leave to two employees and paid another employee a week's pay after she had started a new job.
Judge Hartz found that Evers' testimony that he made a good faith attempt to follow university policy raised an issue that precludes summary judgment on the university's claim that he committed fiscal misconduct. See ruling.
