Court Rejects Stamp |as Filing Fee Payment

(CN) - The Indiana Court of Appeals refused to let a prisoner pay the 22 cent filing fee for a civil rights case with a 42 cent stamp.

Clay Howard tried to sue Debra Daugherty and L.A. Vannetta for alleged violations of his federal rights.

The trial court refused to accept Howard's stamp as payment and dismissed the case. Judge May upheld the decision on appeal.

"The dismissal of Howard's complaint was not error, because the trial court was not obligated to accept the stamp as payment for the filing fee," May wrote.
