NEW YORK (CN) - An agreement for branding of ATM machines in drugstores is too vague to be enforced, the New York Appellate Division ruled.
The trial court dismissed the breach of contract case of drugstore chain Duane Reade Inc. against the ATM company, Cardtronics LP. The two sides disagreed over compensation for transactions after the machines were branded with JPMorgan Chase.
The companies began cooperating on six drugstores in midtown Manhattan before expanding their agreement to place machines in 200 drugstores in greater New York City.
Judge Acosta ruled that the agreement, which included the method for calculating bank transactions, could be interpreted in more than one way. Acosta remanded the case for trial.
