Court Nixes Class Action Over Dodge Neon Gaskets

SAN FRANCISCO (CN) - The 9th Circuit dismissed a class action accusing DaimlerChrysler of breaching warranties and committing fraud by selling Dodge Neons containing defective head gaskets from 1995 to 1998.

The court rejected the warranty claim on the basis that the head gasket failure - and resulting oil leaks - did not occur until after the express warranty period had expired. Similarly, the statute of limitations passed on the fraud claim, the court ruled, and the facts did not support the claim.
