Court Nixes Challenge to Independent Candidate

BOISE, Idaho (CN) - Rex Rammell, an independent candidate for the U.S. Senate, will appear on the ballot after surviving a challenge in Idaho Supreme Court.

Patrick Henry and eight other petitioners challenged the candidacy of Rammell. They claimed Rammell was actually a member of the Republican Party and therefore could not appear as an independent. The petitioners also claimed Rammell had not gathered 1,000 valid signatures to appear on the ballot.

Justice Eismann denied the petition, stating that the issue is whether Secretary of State Ben Ysursa would be exceeding his powers by placing Rammell's name on the ballot.

"(Rammell) timely filed in the appropriate place the required declaration as an independent candidate," Eismann wrote, "and his declaration was accompanied by petitions that county clerks had certified as containing at least 1,000 signatures of qualified electors."
