Court Denies Damages To Victims Of Old National Bank Data Breach

CHICAGO (CN) - Tens of thousands of Old National Bancorp customers whose personal financial information was stolen by a computer hacker cannot recover damages from the Indiana bank, the Seventh Circuit ruled.

Luciano Pisciotta and Daniel Mills filed a class action on behalf of customers whose data was exposed by the "sophisticated, intentional and malicious" hacker when they signed up for ONB's online banking. Plaintiffs said they should be reimbursed for the credit-monitoring services they obtained to protect against identity theft, because the bank had failed to secure its site. Indiana law requires owners of confidential databases to disclose a security breach, which ONB did, but it does not require them to take any further action, the circuit ruled.
