Court Decides Framework in Property Rights Case

SAN FRANCISCO (CN) - In a case of first impression, the 9th Circuit found that a legislative, generally applicable development condition that doesn't require the owner to give up property rights should be reviewed under the ad hoc standards of Penn Central Transportation v. City of New York rather than the nexus and proportionality standards of Nollan v. California Coastal Commission.
