Court Certifies Wage Class Action Against FAA

(CN) - Two air traffic controllers at the Edwards Air Force Base in California presented enough evidence to pursue a class action against the government for overtime wages, the U.S. Court of Federal Claims.

The court in Washington, D.C., ruled that David Whalen and Gregory Turner have shown a "factual nexus" between their situation and the circumstances of other air-traffic controllers working at the base.

They claim the FAA improperly treated them as being exempt from the overtime provisions of the Fair Labor Standards Act.

The court certified the class and instructed the government to identify all of the controllers working at the base since October 2004 - three years before the wage action was filed.
