CARSON CITY, Nev. (CN) - A couple whose property was condemned is entitled to the interest earned on condemnation funds, the Nevada Supreme Court ruled.
Paul and Laurel Moldon sued Clark County for recovery of interest on the condemnation deposit.
"Because condemnation deposits constitute private property to the extent that a party is entitled to the condemnation deposit," the court ruled, "the party is likewise entitled to the interest earned on that deposit."
Justice Michael Douglas reversed the district court's ruling that the Moldons are not entitled to the interest. He ruled that the county's action violated the Moldons' Fifth and 14th Amendment rights.
