County Wins Ruling |Over Use of TVA Funds

(CN) - Henry County is not obligated to share funds from the Tennessee Valley Authority with special school districts, the Tennessee Appeals Court ruled.

Kina Crider, whose children attended one of the schools traditionally earmarked for the money, accused the county of violating several statutory provisions by refusing to share the TVA funds. Exempt from paying taxes, the TVA instead makes payments to the county. Those payments are typically earmarked for education, with a portion allocated to the special school districts.

A trial judge dismissed Crider's motion for summary judgment, and the state appeals court affirmed.

Because the TVA funds are not received "from the state, county (or) other political subdivision," Judge Kirby reasoned, the county has no duty to give a portion of them to the schools.
